This Privacy Policy describes what personal information we collect, why we collect it, how we use it, with whom we share it, and your rights concerning this information. This policy operates in accordance with the provisions of the Israeli Protection of Privacy Law, 1981 ("The Law") and its regulations (including Amendment 13 to the Law).
1.1. Use of the Website is subject to the terms detailed in this Privacy Policy. Please read the Privacy Policy carefully, as browsing the Website and performing actions therein constitutes your consent to the terms contained in this Privacy Policy.
1.2. In the event of inconsistency between any terms of this Privacy Policy and any translation into another language, the Hebrew version will control and prevail on any question of interpretation or otherwise.
1.3. The terms of this Privacy Policy apply to the use of the Website, and the content contained therein, via any computer or other communication device (such as a mobile phone, tablet computers, etc.). They also apply to the use of the Website, whether through the internet network or through any other network or communication means.
1.4. For the purposes of this Privacy Policy, "End-Users" refer to the customers or clients of our direct customers, whose information is processed by our system during their interactions with our customers. This policy clarifies our role as a service provider (data processor) regarding such End- User data.
2.1.1. Upon Contacting Us: Name, contact details (email or telephone), and the content of your inquiry.
2.1.2. As part of the Service (Customers): Full name, telephone number, and email address. Payment details (such as credit card information) are processed by a secure external clearing provider and are not stored in our systems.
2.1.2.1. Google Sign-In (where you choose to register or log in with Google): we receive from Google your name, email address, email verification status, profile picture URL (if available), and, for Google Workspace accounts, the hosted domain. We use this only to create and authenticate your Pingmee account. See Section 12 for Google API Limited Use disclosures.
2.1.2.2. Optional Gmail mailbox connection: if you connect a Gmail account from Integrations, we access Gmail message content, headers, labels, and related mailbox metadata needed to sync conversations, send/reply to email, and manage labels from Pingmee. See Section 12.
2.1.3. End-Users (Customers of our Customers): If you interact with our customers who use our platform (e.g., via WhatsApp or Facebook integrations), we may collect and store your name, telephone number, profile picture and the content of your communications, acting as a service provider (data processor) for our customers.
2.2.1. Browsing data and technical data: While browsing the Website, we may collect technical information such as IP address, browser type, operating system, entry times, and viewed pages.
2.2.2. Cookies: The Website uses cookies, pixels, and similar tracking technologies for its ongoing operation, improving the user experience, collecting statistical data, and (where you consent) tailoring advertisements about Pingmee. These website analytics and advertising technologies apply only to Website browsing activity. They do not use Google Sign-In data, Gmail mailbox content, or any other Google user data obtained via Google APIs. For further information, see Section 6 and Section 12.
3.1. We process your personal information for specific purposes and based on defined legal grounds. Below are a breakdown of the purposes and the corresponding legal basis:

4.1. We do not sell or rent your personal information to third parties. We may share your personal information with third parties and service providers acting on our behalf, solely for the purposes detailed in this policy and in accordance with the provisions of the Law. These entities include:
4.2. Transfer of Information Outside of Israel: Some of the external services we use (such as Google, Meta) may store and process the information on servers located outside the borders of Israel. The use of these services is subject to their respective terms of use and privacy policies, and we ensure that the transfer of information is conducted in accordance with the law and that adequate safeguards are in place for your information.
5.1. Database Owner: For the purpose of the Law, Alex Pinchasov (A.P Software), registration number 203796370, who operates the Website, is the "Controller" of the information database for direct customers, and acts as a "Holder" regarding end-user data managed on behalf of the customers.
5.2. Obligation to Provide Information and its Consequences: You are not legally obligated to provide us with personal information. However, failure to provide certain details may prevent us from providing you with certain services. For example, without providing contact information and basic details, we will not be able to complete and confirm your inquiry. Without providing an email address, we will not be able to add you to our mailing list, at your request. Information collected automatically is required for the proper and secure operation of the Website.
6.1. The Website uses cookies, pixels, and similar technologies (hereinafter collectively: "Cookies") for the ongoing and proper operation of the Website, information security, collection of statistical data, improvement of the user experience, and (where you consent) Website advertising about Pingmee. Cookies on the Website do not access or process Google user data obtained via Google APIs (including Gmail content).
6.2. Cookies are small text files stored on your computer or mobile device while browsing the Website. They allow the Website to recognize your browser, remember certain details (such as login details or user preferences) and collect data regarding your use of the Website.
6.3. Some of the Cookies operated on the Website originate from third parties (such as Google Analytics / Google Ads tags, Meta, etc.). They collect information about preferences and activities on the Website in order to present Pingmee advertisements and measure campaign effectiveness. That activity is limited to Website browsing signals. It is separate from Google Sign-In and from optional Gmail API access described in Section 12. Google user data from Google APIs is never shared with these advertising cookies or used for personalized, retargeted, or interest-based ads. Use of information collected by those third parties via Website cookies is subject to their respective privacy policies.
6.4. Non-essential cookies are activated only after you choose via the Website's cookie banner (accept, reject non-essential, or manage categories). You may change your choice at any time through "Cookie settings" in the Website footer. You may also change your browser settings to block, restrict, or delete Cookies (except for essential Cookies). However, please note that blocking Cookies may impair your browsing experience and prevent you from using some of the Website's services.
7.1. We maintain administrative, technical and physical safeguards designed to protect the information we collect through the Site against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. However, there is no absolute security in these actions and the Site cannot obligate that the services on the site will be completely immune.
8.1. Personal information will be retained for the period necessary to fulfill the purposes for which it was collected, or for a longer period as may be required by law.

9.2. If you are an end-user interacting with one of our customers, you must direct your request to the relevant customer who acts as the Data Controller.
9.3. The exercise of this right shall be done by contacting the Website according to the details appearing below.
10.1. A user who leaves details on the Website, and by their consent authorizes mailings and is added to the Website's mailing list, authorizes the use of those details (as provided for that purpose) for receiving marketing information, updates, and advertisements that the Website will send from time to time. Marketing mailings do not use Gmail mailbox content or other Google user data obtained via Google APIs. Optional use of an email address you also use with Google Sign-In for Pingmee account login does not authorize use of Google API / Gmail data for advertising (see Section 12).
10.2. One must not leave details of another person on the Website without their consent and/or without their presence in front of the screen at the time the details are left.
10.3. When leaving details, the user will be asked to provide personal details such as: first name, last name, phone, and a valid email address (at the Website's sole discretion). Providing incomplete or incorrect details may prevent the ability to use the service and frustrate contact in case of need. In the event of a change in details, they must be updated on the Website.
10.4. It is clarified that there is no legal obligation to provide details on the Website, but without providing them, it will not be possible to receive marketing content and updates from the Website.
10.5. Leaving details on the Website and approving the receipt of marketing content includes, among other things, receiving marketing content, information regarding promotions, updates, and discounts offered to registered users.
10.6. The aforementioned authorization for mailing (receiving marketing content) constitutes the user's consent to the sending of advertising messages pursuant to the Israeli Communications Law (Telecommunications and Broadcasts) (Amendment No. 40), 2008 ("The Communications Law").
10.7. It is clarified that the person leaving the details can remove themselves at any time from the mailing list by clicking on "Unsubscribe" or any similar text that appears at the bottom of every mailing sent, or by contacting the Website via email. As long as the subscriber has not removed themselves from the mailing list as aforesaid, the Website is entitled, subject to the Communications Law, to send direct mailing to the subscriber.
10.8. The Website may cancel a user's registration to the mailing list at its absolute discretion.
10.9. The mailing in its entirety, including all the information appearing therein, is offered "AS IS," and shall be as accurate and correct as possible, however, the information may be incomplete or, alternatively, technical or other errors may have occurred in the information.
11.1. We reserve the right to modify or update this policy from time to time. The updated version will be published on the Website.
Limited Use compliance statement: The use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. If any other section of this Privacy Policy could be read as allowing broader use of Google user data (for example Website marketing, cookies, or advertising language in Sections 2–6 and 10), this Section 12 controls for Google user data obtained via Google APIs.
12.1. This section applies when you (a) sign in or register with Google Sign-In, and/or (b) optionally connect a Gmail mailbox to Pingmee. It describes Google user data access, use, sharing, protection, retention, and deletion. Our OAuth client configuration and in-product consent screens request only the scopes needed for these features. We limit use of that Google user data to providing or improving user-facing Pingmee features. We do not use Google user data for targeted advertising, selling to data brokers, providing to information resellers, determining credit-worthiness or lending, user / personalized / retargeted / interest-based advertisements, creating unrelated databases, or training non-personalized AI and/or ML models.
12.5.1. Access tokens and refresh tokens for Google APIs are stored using industry-standard safeguards on our servers (encryption in transit via TLS; restricted access controls; principle of least privilege). Human access to raw mailbox content is limited to cases needed for security investigations, abuse prevention, support with your explicit consent, or legal compliance, consistent with Google's Limited Use policy.
12.8.1. Pingmee's Gmail integration is an inbox / customer-communication client for businesses that already have a relationship with their contacts. It is not offered for cold emailing, email warming, purchased-list spam, or other prohibited Gmail API use cases. Customers remain responsible for complying with anti-spam and marketing laws when sending messages.
